Előfeltételezésem szerint a közbeszerzések célja nemcsak az, hogy az általános piaci viszonyokat meghaladó, de legalábbis elérő hatékonysággal és biztonsággal kerüljön sor a közhatalmi szervezetek szerződéseinek megkötésére és teljesítésére, hanem hogy a társadalom tagjai elhiggyék, hogy a hatalom a közbevételeket a jó gazda gondosságával használja fel, azaz, hogy a társadalom tagjai elhiggyék, hogy az állam e körben (is) jól működik. A hatékony közbeszerzési rendszer megteremtésének az alapja tehát így az átláthatóság, a transzparencia, ezáltal az információszabadság minél megfelelőbb szintű érvényre jutása és juttatása, mind jogalkotói eszközökkel, mind pedig az azon túli – a civil szférára irányadó normatív szabályok diszpozitivitásából fakadó előnyök kiaknázására fokozottabban alkalmas – magánjogi aktusokkal.Az értekezésemben ezért a fentieknek megfelelően vizsgálni kívántam azt, hogy mi tekinthető a nyilvánosság optimális szintjének a közbeszerzések területén.

Abstract in foreign language

I started from the premise that the purpose of public procurement is not only to ensure that the contracts of public bodies are concluded and performed with an efficiency and safety at least attaining if not surpassing the general market conditions, but also that members of society should believe that the powers that be are using public finances with due care, in other words that the public should believe that the state is functioning well (also) in this area.Thus the basis for creating an efficient public procurement system is transparency, thereby ensuring and enforcing the most appropriate level of freedom of information both through legislative instruments and private law acts, the latter being more suitable to exploit the advantages arising from the permissive nature of the statutes governing civil society. Therefore, I wished to examine in my dissertation what should be considered as the optimal level of openness in the area of public procurement.
